Resumen:
La diversidad cultural ha constituido históricamente un acicate para la evolución de la protección jurídica de las personas. A pesar de ello, la estatalidad ha constreñido y condicionado gravemente el desarrollo de los derechos en beneficio de los grupos mayoritarios o dominantes de cada país. La diversidad cultural sigue planteando hoy retos relevantes para los derechos humanos y su pretendida universalidad. En su estado actual de evolución, el Derecho solo puede responder a ellos de modo fragmentario e imperfecto, tanto en el plano internacional como en el ámbito doméstico.
Abstract:
Historically, cultural diversity has served as a catalyst in the evolution of the legal protection of human beings. Nevertheless, statehood has restricted and dramatically conditioned the development of rights, to the benefit of dominant or majority groups in each country. Cultural Diversity keeps formulating relevant challenges for human rights and its eventual universality. At this stage of development, Law can only play a fragmented and imperfect role, both at the international and domestic level.
